Term's &Conditions

This ticket issued by By-Bus trading as New England Coaches (herein called the Company) accepted by Passengers subject to the following conditions.

1: BAGGAGE ALLOWANCE: 2 Items (maximum 20kg per item ) of personal effects carried free. If loading is available, excess baggage will be Carried at the Company’s standard rate ( $20.00 per Item ) otherwise it will be forward on the next available service.

2: The Company is not a common carrier and reserves the right to refuse any passenger, baggage or goods without assigning any reason therefore.

3: The Company accepts no responsibility to loss or damaged to baggage arising out of or in any way incidental to the service of the accommodation of the passenger or the transfer of any baggage between the vehicle and any place accommodation whether such loss or damage may be due or alleged to be due to negligence or misconduct on the part of the Company its servants or agents or otherwise howsoever. VALUABLE ITEMS (e.g jewellery, expensive equipment, cash etc.) should be carried by the passenger by their person. New England Coaches accepts no responsibility for loss or damaged of such items.

4: No condition of travel other than the endorsed hereon or elsewhere on this ticket will be recognised. Verbal promises by booking agents or clerks will not be recognised.

5: The Company shall not be liable for any loss or any alternative means of travel which may arise and any additional expense so arising shall be the liability of the passenger. The Company reserves the right to cancel this service or to vary it in any way.damaged which may arise in the event of the cancellation of the service or the abandonment of the service during the course thereof(should the Company or any of its servants or agents decide that such abandonment is necessary) or of any deviation or delay in any service arising from any cause whatsoever, in any such event the Company will not be liable in any way for the cost of any accommodation other than that contemplated by the original service or for

6: The Company may arrange for any other person to undertake the service hereby contracted for or any part thereof and such person and his servants and agents shall be protected by and entitled to the benefits of these conditions to the same extent as the Company but the Company shall not be in any way responsible or liable to the passenger or any person claiming by through or under him for any loss or injury (whether to person or property ) suffered by the passenger directly or indirectly resulting from any act or thing done or omitted ( whether negligent or not ) by such other person his servant agents or employees.

7: This ticket entitles the passenger on a road service as distinct from the tour, to transportation as indicated on the face hereof but not to meals or refreshments and accommodation which may be obtained enroute. These Conditions shall be read and construed subject to “ The Carriage of Goods by Land ( Carries Liabilities ) Act of 1967 ( Queensland )” in respect of any Agreement entered into by Queensland with the Company for the carriage by land of goods and in respect of any agreement entered into any other state or Territory these conditions shall be read and construed subject to the provisions of any relevant comparable Act or Ordinance to the intent that any provision herein contained shall apply in all cases except where and to the extent is repugnant to the provisions of the relevant Act or Ordinance. Any proceeding against the Company shall be bought on the State of Queensland.

8: To the extent that the provisions herein are repugnant to the provisions on Part V of the Trade Practices Act 1974 the same shall not apply.

9: The expression “The Company” shall also include The Company’s servants, agents, and employees with whom the Company may have made arrangements as envisaged in Clause 5 hereof and his servants agents and employees: the expression “the passenger” shall mean the person to whom this ticket is issued or who is carried by virtue thereof the expression “person” shall include a firm or corporation: and the singular shall include the plural and vice-versa and words importing any gender shall include the other gender .

10: Open dated second stage tickets are valid for 30 days only and must be confirmed 24 hours prior to intended travel.

11: Smoking is not permitted on coaches.

12: Food and Drink is not permitted on coaches.

13: Cancelled Tickets: Tickets are NOT refundable. Cancelled tickets are valid for use for 6 months from date of purchase.( Min 24hr Notice prior to Scheduled Departure Time)
